A significant ruling from a federal appeals court has emerged in the ongoing legal dispute concerning book removals in Escambia County. The court decided that school board members may be required to give depositions regarding their reasoning for pulling library books and educational materials.
This legal case, initiated in 2023 by book publishers, parents, and the PEN American Center, challenges the school board’s prior actions that led to the removal of books considered to have ‘extreme sexual content,’ promote an ‘LGBTQ agenda,’ ‘race-baiting,’ and include ‘graphic rape scenes and language.’ The board attempted to invoke legislative privilege to evade such depositions. However, the appeals court sided with the trial court ruling, indicating that the board’s actions were administrative rather than legislative.
